Terms of Service
Effective May 2, 2026
These Terms of Service ("Terms") govern your access to and use of RSVP'd, an AI-assisted event planning platform operated by PositionScale ("we", "us", or "our") from Vancouver, British Columbia, Canada. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
1. The service
RSVP'd helps people plan events. The platform supports weddings, baby showers, birthdays, anniversaries, corporate events, dinner parties, graduation parties, and custom event types. Features include guest list management, vendor coordination, budget tracking, AI-assisted communication, contract review, day-of logistics, and integrated email, SMS, and WhatsApp messaging.
We may add, change, or remove features at any time. We will give reasonable notice for material changes that reduce functionality you currently rely on.
2. Accounts
You must be at least 18 years old to create an account. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately if you suspect unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraud, abuse, or illegal activity.
3. Plans and billing
We offer the following plans:
- Free — Limited features for weddings (3 vendors, 50 guests, 100 MB storage, 1 event), and full access for non-wedding event types with the same limits. No credit card required.
- Pro ($49 USD/month) — Unlimited use for one wedding, plus AI execution features (vendor discovery, send, negotiate, coordinate), the Communication Hub, the Day-Of live event hub, visual seating chart, and contract review. Includes access to all non-wedding event types.
- Planner ($399 USD/month) — White-label use for unlimited events of any type for the planner's clients. AI usage and storage may be metered as described at sign-up.
- Trial — 14-day Pro trial; no credit card required.
Paid plans renew monthly until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months except where required by law. Prices may change with at least 30 days' notice; existing subscriptions are honoured at the previous price until the next renewal after the change date.
Payments are processed by Stripe. We do not store your full card number; Stripe handles all payment data under their own terms and PCI-DSS compliance.
4. Your content
You own the content you put into RSVP'd — guest lists, vendor information, messages, photos, contracts, notes, and anything else you upload or generate. You grant us a limited license to process, store, transmit, and display this content solely to provide the service to you and your invited collaborators.
You are responsible for the legality of the content you upload, and for getting any consent needed before sharing third-party information (for example, guest contact details). Do not upload content you do not have the right to share.
5. AI features
RSVP'd uses third-party AI models (currently Anthropic Claude and Cloudflare Workers AI) to generate emails, summarize contracts, classify vendor responses, suggest budgets, and assist with planning. AI output is generated automatically and may be inaccurate, incomplete, or unsuitable for your situation. You are responsible for reviewing AI-generated content before sending it, signing contracts based on it, or relying on it for important decisions. We are not your lawyer, accountant, or professional planner.
We send the minimum data needed to generate each AI response (event details, vendor context, conversation history) to our AI providers. We do not use your data to train third-party AI models, and we have configured providers, where supported, to disable training on inputs.
6. Communication features
When you connect Gmail, Outlook, WhatsApp, or SMS, you authorize us to send and receive messages on your behalf as you direct. You are responsible for compliance with applicable anti-spam and consent laws (CAN-SPAM, CASL, GDPR, TCPA), including obtaining recipient consent where required. Do not use RSVP'd to send unsolicited marketing messages or spam.
7. Acceptable use
You agree not to:
- Use the service for unlawful, fraudulent, or abusive purposes
- Send spam or harass anyone through any communication channel
- Attempt to gain unauthorized access to any part of the platform
- Reverse engineer, scrape, or systematically extract platform data
- Resell or sublicense the service without our written permission (the Planner tier is the only sanctioned reseller arrangement)
- Upload malware, illegal content, or content that infringes intellectual property rights
- Misrepresent your identity or the source of communications sent through the platform
8. Third-party integrations
RSVP'd connects to third-party services on your behalf, including Google, Microsoft, Apple, Stripe, Resend, Twilio, Meta (WhatsApp), Cloudflare, Anthropic, and others. Your use of those services is governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services. If a third-party service changes its terms or becomes unavailable, related features may stop working.
9. Termination
You may close your account at any time from settings. We may suspend or terminate your account for material breach of these Terms, non-payment, or to comply with legal obligations. On termination, you can export your event data for 30 days; after that, we may delete your data, subject to backup retention and legal holds. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
10. Disclaimers
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that AI output will be accurate. Vendor recommendations, contract analysis, and budget suggestions are informational only and not a substitute for professional advice.
11. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100). We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, lost goodwill, or substitute services. Some jurisdictions do not allow these limitations; in those jurisdictions our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your content, your use of the service, your violation of these Terms, or your violation of any law or third-party right.
13. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will email the address on your account at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
14. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict-of-laws principles. You and we agree to the exclusive jurisdiction of the courts of British Columbia for any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing in these Terms limits any non-waivable rights you have as a consumer under the laws of your home jurisdiction.
